Pre-Information Form

(Prepared in accordance with Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.)

This form has been prepared to inform the consumer before the purchase in respect of in-app purchases made within the WIN mobile application (WIN Premium subscription, etc.). You are directed to this text from the purchase screen or the in-app “Legal” section; the aim is for you to read this information and (as presented in the app flow) confirm it before incurring a payment obligation.

All purchases are processed through the Apple App Store (iOS) and/or Google Play Store (Android). Price, payment method and refund procedures may vary depending on the store and your device. WIN does not process your card or payment details directly; collection is carried out through the store infrastructure.

You may send complaints, requests or suggestions to the provider through in-app support channels or the contact details stated in the Terms of Use.


2. Essential Characteristics of the Service That Is the Subject of the Contract

The subject of the contract is the digital service offered through the WIN mobile application. The main example is the WIN Premium subscription (weekly or monthly packages). Essential characteristics:

  • Type of service: Access to paid in-app features (subscription).
  • Performance: In digital form, immediate access after purchase confirmation.
  • Scope: Use of Premium features for a given billing period depending on package selection (e.g. 1 week or 1 month). Premium features: right to view 20 decks per day (Standard: 5); x2 visibility on decks; deck filtering; profile hiding; read receipts in messages; seeing online/offline status; seeing your own score and scores given to you / to others by users. Current package names, durations and the full feature list are shown on the purchase screen and in the app.

Physical delivery of goods or cargo is not involved; the transaction is within in-app purchase.


3. Total Price Including Taxes and Additional Costs

  • Price: The total price including all taxes for the package you select is shown on the purchase screen (in the app and/or on the store screen before moving to the store payment screen). Prices may vary depending on market conditions, campaigns and regions.
  • Currency and region: The price is displayed according to the region of your Apple or Google account and the store rules.
  • Additional costs: WIN does not request additional costs specific to the order. Internet or mobile data usage is subject to your normal tariff.
  • Invoice / receipt: For in-app purchases, the legal document is the purchase receipt issued by Apple/Google. WIN invoices these sales directly to the stores.

4. Payment, Time of Performance and Complaint Methods

Payment methods: Payment is made with a payment instrument linked to your Apple App Store or Google Play Store account (credit card, debit card, operator billing, etc.). Accepted payment instruments and any additional costs are shown on the store screen; WIN does not collect card/account details directly.

Delivery / time of performance: The service is performed immediately once purchase confirmation is given by the store; Premium access is activated at the same time.

Methods for resolving complaints: You may submit complaints regarding subscription, billing or technical access through in-app support or legal@whoisnextapp.com. Important: No fee refund is made for accounts closed due to breach of Community Rules.


5. Right of Withdrawal Information

General rule (Distance Contracts Regulation, Art. 9): The consumer has the right to withdraw from the contract within fourteen days without giving any reason and without paying a penalty. For contracts concerning performance of services, the withdrawal period begins on the day the contract is concluded.

Exceptions (digital service — Regulation, Art. 15(1)): The right of withdrawal cannot be used in the following cases:

  • Art. 15(1)(ğ): Services performed immediately in electronic form or intangible goods delivered immediately to the consumer.
  • Art. 15(1)(h): Services the performance of which has begun with the consumer’s consent before the end of the withdrawal period.

Because access to WIN Premium begins immediately upon purchase and/or performance has begun with your consent, exceptions to the right of withdrawal may apply. This situation and the warning that “performance of the service may begin immediately” are shown on the purchase screen (see Subscription and Purchase Terms — Section 4).

Withdrawal notice (Art. 11): Where your right of withdrawal exists, it is sufficient to send the notice to the provider in writing or by durable medium (e-mail, etc.).

Deficient information (Art. 10): Where you have not been informed as required regarding the right of withdrawal, the provisions on not being bound for fourteen days and (where conditions arise) a one-year period remain reserved.


6. Refund and Price Repayment

Special price repayment commitment: WIN does not undertake an additional goodwill refund policy such as “refund within the first X days”.

Refund requests: Because in-app purchases are made through the Apple App Store or Google Play Store, refund / reimbursement requests are in most cases subject to the procedures of the relevant store (Apple or Google). For a refund request:

Mandatory consumer rights: Your mandatory refund and compensation rights arising from the Law and the Distance Contracts Regulation remain reserved. For defective service and optional remedies, Subscription and Purchase Terms Section 9 and the Distance Sales Agreement apply.


7. Payment Obligation Warning and Pre-Information Confirmation

Payment obligation (Regulation, Art. 8): Clicking a confirmation button such as “Buy”, “Subscribe” or similar states that the order creates a payment obligation and that you accept that obligation. Immediately before incurring a payment obligation, price and basic information (Regulation, Art. 6(2)) are also shown on the purchase / payment screen.

Pre-information confirmation (Regulation, Art. 7): In the in-app flow, you may be asked to confirm that you have read this Pre-Information Form and (before moving to the store screen) the payment obligation warning. Until confirmation is given, the contract is deemed not to have been concluded.

This Pre-Information Form is read together with the Distance Sales Agreement and the Subscription and Purchase Terms and enters into force together with purchase confirmation.


8. Deposit and Additional Financial Obligations

Under this contract WIN does not require deposit, advance payment or similar additional financial obligation. Payment is limited only to the price of the subscription package you select as shown on the purchase screen.


9. Resolution of Disputes

As a consumer under Law No. 6502:

  • The Consumer Arbitration Committee and Consumer Court routes are open (within the monetary limits announced by the Ministry of Trade).
  • Provisions concerning the requirement to apply to a mediator before filing an action under Article 73/A of the Law apply.

10. Other Matters

Fee for means of communication: Using the app and purchase screens does not give rise to additional cost from WIN beyond your normal internet/data tariff (Regulation, Art. 5(1)(e)).

Protection of personal data: Personal data processed in purchase and subscription processes are explained under the Privacy Policy and the KVKK Disclosure Text. Your payment information is processed by the store (Apple/Google) and payment institutions; WIN does not store this data.

Subscription cancellation: To terminate the subscription you must carry out cancellation through the store account (Apple or Google) where you made the purchase. Deleting the app or your WIN account does not automatically cancel the subscription. Steps are summarised in Subscription and Purchase Terms Section 8.

iOS / Android differences: Price, package names, payment screen texts and store policies may differ between Apple and Google. The information on the store screen you use at the time of purchase prevails.


11. Confirmation of the Form and Entry into Force

Before giving purchase confirmation:

  • That you have read this Pre-Information Form,
  • That you have reviewed the Distance Sales Agreement and the Subscription and Purchase Terms (to the extent presented in the app flow),
  • That you have been informed of rights and obligations including the right of withdrawal and exceptions,

you are deemed to accept, declare and undertake. This confirmation is provided through in-app “I have read and accept” or similar consent.

WIN reserves the right to update this Pre-Information Form in line with legislative changes or business requirements. The current text is published in the in-app “Legal” section and at whoisnextapp.com.
