In-App License Agreement (EULA)

This document is an End User License Agreement (“EULA”) governing the licensing of the WIN mobile application (“Application”) as software. This EULA explains under what conditions you may use the Application software, what restrictions apply, intellectual property rights, and additional store/operating system terms.

This EULA is an integral part of the Terms of Use and applies together with it. For matters relating to the Application software (installation, device scope, technical restrictions), this EULA prevails; for all other matters, the Terms of Use prevail.

  • The Application is not sold; it is licensed: This EULA does not grant you ownership of the Application; it only grants a limited licence to use it subject to certain conditions. - Personal use: The licence is personal, non-commercial, non-transferable, non-sublicensable and revocable. - Restrictions: Reverse engineering, decompilation, copying/distribution, circumventing security measures, automation/bot use and use of the Application outside its intended purpose are prohibited. - Store rules: If the Application is downloaded from the Apple App Store and/or Google Play Store, the relevant store’s terms also apply. - Personal data: Certain personal data is processed through the Application; such processing is not governed by this EULA but by the Privacy Policy and KVKK Privacy Notice and, where applicable, the Explicit Consent Texts.

Section 1: Purpose, scope and acceptance

This section explains the purpose of the EULA, what assets it covers, how it relates to other documents, and how it is accepted. By downloading/installing or using the Application, you are deemed to have accepted this EULA.

This EULA is entered into between WIN TECH Bilişim Organizasyon ve Ticaret A.Ş. (Trade Registry No: 1128235, MERSIS No: 0811159971200001), operator and rights holder of the Application (“WIN TECH” or, for short, “WIN”, “operator”, “we”), and the natural person who accepts this EULA by downloading/installing/using the Application (“User”, “you”).

1.2 Scope

The following are included in the scope of this EULA (without limitation):

  • The Application itself (mobile application file, interface and software components),
  • Application updates, patches, upgrades and new versions,
  • Software/SDK components embedded in or working together with the Application,
  • Access keys, technical verifications and licence controls required to use the Application,
  • Software features offered through the Application (e.g. user interfaces, filters, verification flows).

This EULA is read together with the Terms of Use for matters such as the general operation of the service offered through the Application, account/membership rules, community rules, content and moderation, liability limits and dispute resolution.

1.3 Acceptance and entry into force

This EULA:

  • enters into force and becomes binding on you when you download, install or use the Application,
  • when you give confirmation such as “I accept” on an EULA/Terms screen within the Application,
  • when you continue to use the Application.

If you do not accept this EULA, do not download, install or use the Application; if applicable, remove the Application from your device.

1.4 Relationship with other texts and precedence

This EULA has been prepared taking into account, in particular, protection of the Application software under copyright/trademark law within the scope of Law No. 5846 on Intellectual and Artistic Works (FSEK) and Industrial Property Law No. 6769 (SMK), as well as consumer and electronic transaction frameworks such as Law No. 6502 and Law No. 6563.

This EULA applies together with the following texts:

If there is a conflict between texts:

  • this EULA applies with respect to licensing of the Application software and device/installation/technical restrictions,
  • the Terms of Use apply with precedence for all other matters.

Mandatory legislation and store rules are reserved.

1.5 Changes

WIN may update this EULA due to changes in legislation, security needs, product development or store requirements. The current text may be published in the in-app “Legal” area and on whoisnextapp.com (opens in a new tab).

If you continue to use the Application after a change, that means you accept the updated EULA. For material changes, in-app notification and/or email may be used where reasonably possible.


Section 2: Definitions

Terms used in this section have the same meaning throughout the EULA.

StoreThird-party application store from which the Application is downloaded, such as the Apple App Store and/or Google Play Store.
DeviceThe iOS/Android mobile device or tablet on which you install the Application.
AccountThe user account allocated to you within the Application (e.g. via Google Sign-In).
Platform ContentApplication software, interface, design, brand, logo, database and other content owned by or licensed to WIN.
User ContentContent you provide, such as profile information, photos and messages (details in the Terms of Use).
UpdateA new version of the Application, a patch, bug fix or security update.
Open Source ComponentOpen source software that may be used within the Application and is subject to its own licence terms.

Section 3: Nature and scope of the licence

This section explains the scope in which WIN grants you a licence and the basic characteristics of the licence. The licence is for personal use only and may terminate automatically in case of breach.

3.1 Grant of licence (WIN → user)

Subject to your compliance with this EULA and the Terms of Use, WIN grants you a personal, worldwide, royalty-free, non-transferable, non-exclusive, revocable and non-sublicensable licence to use the Application in the manner intended by WIN.

This licence is limited to:

  • downloading, installing and running the Application on your device,
  • using the features offered by the Application,
  • using the Application only for personal and non-commercial purposes.

3.2 No ownership; reservation of rights

All intellectual property rights in the Application belong to WIN and/or WIN’s licensors. The right granted to you under this EULA is a licence to use. This EULA may not be interpreted as:

  • a sale of the Application,
  • transfer of ownership in the Application,
  • transfer of source code, algorithms or technical designs.

3.3 Device and platform scope

Which devices and under which store terms the Application may be used may vary depending on the store from which it was downloaded. The explanations below set out the general framework; store terms and device manufacturer terms are reserved.

If the Application was downloaded from the Apple App Store:

  • You may use the Application on Apple-branded devices under your control to the extent permitted by App Store terms.

  • For security and licence management reasons, you may only have one active session at a time on one device with your account. Signing in on a new device may end the session on the previous device.

  • The App Store’s digital rights management (DRM) and technical restrictions apply.

3.4 Non-transferability of the licence

You may not assign, rent, lend, sell, sublicence the licence under this EULA to third parties, or in any way allow third parties to use the Application on your behalf.

3.5 Duration of the licence and automatic termination

The licence remains in force for as long as you comply with this EULA and the Terms of Use. In case of breach:

  • your licence terminates automatically,
  • you must immediately stop using the Application,
  • you must remove the Application from your device.

If your account is suspended or closed, your licence and right of access may also terminate (see Terms of Use).


Section 4: Use restrictions and prohibitions

This section sets the boundaries of the licence and lists what you must not do when using the Application. Attempts to circumvent technical restrictions may lead to account closure and legal liability.

4.1 General restrictions

You may not use the Application:

  • for commercial purposes (advertising, marketing, recruitment, data collection, sales, etc.),
  • to develop products/services that would compete with WIN,
  • in a way that infringes third-party rights,
  • in a manner contrary to applicable law.

4.2 Technical restrictions (reverse engineering and security)

Attempting to access the Application’s source code, reverse engineering, circumventing security measures or manipulating the Application is prohibited.

You agree in particular not to do the following (without limitation):

  • copy, reproduce, distribute or publish the Application or any part of it,
  • perform reverse engineering, decompilation or disassembly on the Application,
  • convert to source code or attempt to obtain source code,
  • disable or circumvent security/copy protection/DRM, licence verification or similar technical measures,
  • use code/tools that interfere with, disrupt or harm the operation of the Application (bots, scripts, cheating via emulator, automation tools, etc.),
  • scrape, index or automatically crawl data through the Application,
  • access or publish the Application’s APIs or technical interfaces without written permission.

4.3 Prohibitions relating to account and access security

The following are prohibited:

  • allowing third parties to use your account or device,
  • using another person’s account,
  • attempting to gain unauthorised access to the Application,
  • researching or testing security vulnerabilities (unauthorised pentesting),
  • collecting or sharing content in a way that infringes other users’ privacy.

Section 5: Intellectual property, content and trademark rights

Application software and Platform Content belong to or are licensed by WIN. Rights and licences for User Content are governed primarily in the Terms of Use.

5.1 Platform Content (application software and interface)

The Application is protected under FSEK Law No. 5846 and related legislation with respect to software code, interface designs, text, images, database structures and similar elements. Trademarks, logos and distinctive signs on the Application are protected under SMK Law No. 6769 and related legislation.

Without WIN’s express written permission, it is prohibited to:

  • reproduce Platform Content in whole or in part,
  • modify it,
  • communicate it to the public,
  • use it for commercial purposes.

5.2 User Content (profile, photo, messages, etc.)

Your rights in User Content and the licences you grant to WIN are set out in the Terms of Use, in particular in the “Content and intellectual property” section. Without repeating User Content licences, this EULA confirms the following principles:

  • When uploading content, you are responsible for not infringing third-party rights and for having any necessary permissions.
  • WIN requires a certain licence to use your Content in order to provide the Services; scope and limits are set out in the Terms of Use.

5.3 Infringement notices (copyright/trademark)

For copyright or trademark infringement notices and “notice and takedown” processes:

Section 6: Third-party software, open source and integrations

The Application may include third-party services and open source components. Those components may be subject to their own licence/terms and, in case of conflict, the relevant third-party terms may apply.

6.1 Third-party services and SDKs

The Application may use third-party service providers and software development kits (SDKs) for authentication, notifications, hosting, analytics or security purposes. The main third-party services used in the Application are:

  • Google Firebase: Data storage, notification management, analytics and error logging.
  • Google Gemini 2.5 Flash: Profile photo and selfie verification (pose and consistency).
  • Google Cloud Vision: Inappropriate content detection (Safe Search).
  • MeiliSearch: In-app search and filtering optimisation.
  • Twilio: SMS and email verification processes.
  • Google Cloud Vision & Run: Content moderation and technical pose verification processes.

Further details on the use of such services and data processing roles are explained in the Privacy Policy. WIN is not liable, to the extent permitted by applicable law, for outages or incompatibilities arising from third-party providers’ own systems/terms.

6.2 Open source components

The Application may contain open source software. Those components are subject to their own licence terms. If there is a conflict between open source licences and this EULA, the relevant open source licence applies to the extent of the conflict.

It is recommended to provide an “Open Source Licences” page/screen within the Application or on the website. This need is also tracked separately in gelistirme_notlari.md.


Section 7: Updates, version management and support

The Application may be updated; some updates may be mandatory. Older versions may pose security risks and may not work.

7.1 Updates and new versions

WIN may update the Application for security, compatibility and functionality purposes. Updates may take the form of:

  • bug fixes,
  • security patches,
  • performance improvements,
  • new features.

7.2 Automatic updates and store controls

Depending on your store settings and device settings, Application updates may be downloaded/installed automatically. You are responsible for using the current version of the Application. If you turn off or delay updates, some features may not work.

7.3 Support and contact

For technical support, maintenance and licence requests relating to the Application, you may use our official contact channel support@whoisnextapp.com. Support may also be provided via the in-app “Help” area and forms on whoisnextapp.com (opens in a new tab).


Section 8: Device permissions, technical requirements and security

Some features of the Application (location, camera, microphone, etc.) depend on device permissions. If you do not grant permission or revoke it, relevant features may not work.

8.1 Minimum system requirements

Minimum operating system versions and device requirements supported by the Application are stated on the relevant store page and/or in in-app notices. WIN is not liable if the Application does not work on unsupported devices or operating system versions.

8.2 Permissions (location, camera, microphone, notifications)

The Application may request the following permissions as required for its functions:

8.3 Selfie/face verification and biometric risk

If the Application includes features such as selfie/face verification, those processes may involve personal data and even special categories of data. Therefore, the relevant privacy notices and explicit consent processes are governed by:

8.4 User security responsibility

You are responsible for taking measures necessary to protect your account information and device security, prevent unauthorised access and maintain the security of your device. Actions performed through your account are generally deemed to be your actions (details in the Terms of Use).


Section 9: Disclaimer of warranty and liability

The Application is provided “as is”; uninterrupted or error-free operation is not guaranteed. Your mandatory consumer and statutory rights are reserved.

The Application and Platform Content are provided, to the extent permitted by applicable law, “as is” and “as available”. WIN does not warrant or undertake that:

  • the Application will operate uninterrupted or error-free,
  • it will be compatible with every device/operating system combination,
  • matching/compatibility results will achieve any particular outcome.

This section does not eliminate your mandatory consumer rights. Disclaimers of liability and liability limits relating to the Application and Services are also set out in the Terms of Use.


Section 10: Termination and end of licence

Breach of the EULA may lead to termination of the licence and closure of access. Deleting the Application does not by itself necessarily delete your account.

10.1 Termination by the user (removing the Application)

You may remove the Application from your device. However, removing the Application does not necessarily delete your account automatically. Account deletion and data retention processes are carried out under the Terms of Use and Privacy Policy.

10.2 Termination / access restriction by WIN

WIN may suspend, restrict or close your account in case of breach of this EULA or the Terms of Use, security risk, suspected abuse or legal requirements. In that case your licence ends.

10.3 Consequences of termination

When the licence ends, you must:

  • immediately stop using the Application,
  • remove the Application from your device,
  • act in a way that does not infringe WIN’s rights in Platform Content.

10.4 Survival

Termination or expiry does not prevent provisions that by their nature should continue to apply after termination. In particular, provisions on intellectual property, restrictions, disclaimers and dispute resolution remain in force.


Section 11: Store/platform-specific provisions (Apple & Google)

If you download the Application from the Apple App Store or Google Play Store, the relevant store’s terms apply. Store providers are not parties to this EULA (subject to the special provisions below).

For iOS users: If the Application was downloaded from the Apple App Store, this EULA is between you and WIN; Apple is not a party to this EULA.

  • Store terms: App Store terms of use and Apple’s relevant policies/rules also apply. This EULA may not be interpreted to override store terms.

  • Maintenance and support: To the extent permitted by applicable law, the obligation to maintain and support the Application rests with WIN; Apple has no obligation in this regard.

  • Warranty and claims: Apple does not warrant the Application; (subject to mandatory cases) WIN is responsible for product liability, consumer claims and similar matters.

  • Intellectual property claims: (Subject to mandatory cases) assessment and processes regarding claims that the Application infringes third-party intellectual property rights are conducted by WIN.

  • Third-party beneficiary: If the Application was downloaded from the Apple App Store, Apple and Apple’s affiliates are third-party beneficiaries of the relevant provisions of this EULA and may enforce this EULA against you.


Section 12: Governing law and miscellaneous

Governing law and dispute resolution principles for this EULA are determined primarily by reference to the Terms of Use. Your mandatory consumer rights are reserved.

12.1 Governing law and jurisdiction

Turkish law applies to the interpretation and application of this EULA, subject to mandatory statutory provisions. For resolution of disputes, competent courts and consumer remedies, the relevant sections of the Terms of Use apply.

12.2 Severability

If any provision of this EULA is held invalid or unenforceable, the validity of the remaining provisions is unaffected.

12.3 Assignment of rights

WIN may assign its rights and obligations under this EULA in compliance with law and subject to necessary notices. As a user, you may not assign the licence under this EULA.
